No substitution, cash equivalent or transfer of the prizes is permitted except at the sole discretion of Sponsor, who reserves the right to substitute a prize of equal or greater value in the event the prize is unavailable for any reason. Winner will receive prize within thirty (30) business days after winning notification. Winners are responsible for payment of all taxes on the prize and for any other expenses associated with the prize not specifically described herein. In the event of a dispute as to the identity of a winner, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry if the entry was made without purchase or the authorized account holder of the credit card used to make the purchase if entry was made with purchase. 5. ELIGIBILITY: Promotion open to all legal U.S. residents (excluding residents of Puerto Rico) who are 18 years or older as of May 25, 2010. 6. NOTIFICATION and PUBLICITY: Winners will be notified via e-mail. By entering this promotion and participating in the Microsoft Summer Giveaway, you hereby represent, warrant and agree to the following: (A) I am a U.S resident 18 years of age or older, (B) I FULLY UNDERSTAND, ACKNOWLEDGE AND AGREE THAT MY NAME, LIKENESS, AND PHOTO/VIDEO IMAGES AND VOICE MAY BE PUBLICLY DISPLAYED TO A WORLDWIDE AUDIENCE, and (C) I hereby license and give all clearances and permissions necessary or beneficial for such use of my name, likeness, image, portrait, picture, and voice as applicable, and will be required to complete and sign an Affidavit of Eligibility/Liability Release and, where legal, a Publicity Release, which must be returned, properly executed, within fourteen (14) days of issuance of prize notification. If these documents are not returned within this time period, or the notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner. If the winner fails to take delivery of the prize, the prize will be forfeited and awarded to an alternate winner.

Limitation of Liability: By participating in the promotion, entrants agree that Sweepstakes Entities, their respective parent companies, affiliate and subsidiary companies, advertising and promotions agencies, and all of their agents, directors, officers, representatives, shareholders and employees will have no liability whatsoever for any injuries, death, losses, or damages of any kind resulting from participation in the promotion or acceptance, possession or use of any prize that may be awarded. Sponsor is not responsible for printing or typographical errors in any promotion-related materials, or for stolen, lost, late, misdirected, damaged, incomplete or illegible entries. If Sponsor determines, in its sole discretion, that there is any suspected or actual electronic tampering with the promotion, or if technical difficulties compromise the integrity of the promotion, Sponsor, in its sole discretion, reserves the right to void any entries submitted fraudulently or cancel or modify the promotion. Any deliberate attempt by an entrant or any other individual to damage any web site or undermine the legitimate operation of promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
