Sales Tax


Do I have to pay sales tax?
Yes, if the Ship To address on your order is in the following states:

California
Massachusetts
Tennessee
New York


How much is sales tax?

By law, sales tax is automatically computed on products and shipping charges. To see the total sales tax that will be charged on your order, click on the "checkout" button. This will not complete your order; it will only display your order summary, which shows what your order will look like including how much tax will be charged.


Are there any exemptions?

Yes. But the tax exempt rules are very specific. We can exempt you if you fax the following to
949-389-2635 with this cover sheet.


California:

  1. If your Ship To address is in California we will credit you for tax paid. You must provide your California Resale Certificate (Form BOE-230) (NOTE: A California Seller's Permit, Form BOE-442, will not do.) One can be found by clicking here
    AND
    Your Ship To address contains the same company name listed on the California Resale Certificate.
    OR
  2. You fax us your government agency exemption documents to the fax number above. The government agency must be listed in the Ship To information of the order. If you are a government agency using an I.M.P.A.C. card, please fill out Regulation 1614, by clicking here

    NOTE: Pre-purchase tax exemption is possible if you fax the tax exempt documentation with a valid email account referenced on the fax. This is only valid if you have already set up a Buy.com Account. Guest Checkout orders may only be exempt from tax post-purchase, and you must fax in the tax exempt document after each order is placed.


New York:

  1. If your Ship To address is in New York we will credit you for tax paid. You must provide your New York Resale Certificate (Form ST-120) The form can be found by clicking here
    AND
    Your Ship To address contains the same company name listed on the New York Resale Certificate. For more information click here

  2. You fax us your government agency exemption documents to the fax number above. The government agency must be listed in the Ship To information of the order. For more information,click here.

The rules are similar in other states. Please contact your respective state tax board for specific instructions and forms.


2007 MA Tax Holiday
If your order qualifies for a sales tax refund under the Massachusetts Tax Holiday guidelines for August 11, 2007 & August 12, 2007, please fax in the Sales Tax Holiday Purchaser’s Certification of Nonbusiness Use form and a copy of your Buy.com receipt to the number above. If we determine that a refund is due after reviewing the faxed documents, your original payment method will then be refunded.

NOTE: Please do not assume that if you have a business license you are tax exempt. Please do not assume that if you work for a government agency or a school that we can mark your account tax exempt. Your paperwork must be valid, correct, on file, and it must match your Ship To address on your order so that Buy.com is compliant with state laws.


What happens then?

If your paperwork is correct, we will keep it on file and we will amend your account so that you are not charged tax on future orders. We will credit you for tax paid on orders you bring to our attention as long as they were placed within the past 30 days. We do not credit for tax paid on orders over 30 days old since we have already remitted the tax payment to the state.

Once your account is tax exempt, you will have a tax option on the Checkout page. It will default to not charge you tax, but you may de-select the option and pay tax if you wish.
